some people use the super bowl to spread stories of inspiration and love and determination. but others seem to use the super bowl and the ads surrounding it because there are so many people that tend to pay attention to spread hate. msnbc put this tweet out. we're going to let our viewers decide here. it said "maybe the right wing will hate it but everyone else will go oh. the adorable new cheerios ad with a biracial family." certainly sparking a lot of emotion and reaction as they planned, i'm sure. but also spreading in a way, you know, bigotry against those who may not believe the same as their network. did it backfire? >> sure. msnbc was saying essentially that conservative people hate interracial families. shortly after they posted that tweet, michelle malkin encouraged biracial

families to post their families up. the reaction must have scared msnbc. in no time they took down the tweet. then they apologizeed. there was a call for an apology from the president of msnbc. we've got a woman from a biracial family. she saw that comment from msnbc and this is how she felt. >> we are definitely offended. me, it hit close to home because we're newlyweds, newly married. soon we're going to be bringing a family into this world. and i just, i feel like we're already fighting so many stigmas that fighting the stigma of being a biracial couple, a conservative biracial couple that it doesn't exist. we're here and i don't want to bring kid to where they feel like they're fighting the same stigma. >> brian? >> steve, just to continue on this, cheerios decided

for the first time they're going to have a super bowl ad out and they're going to be talking about that. in it is depicted a biracial couple and a little girl finding out she is going to have a brother or sister at which time out of nowhere that tweet comes out challenging the r.n.c. and it was suggested to boycott the entire network. this is the latest time. remember the last time we were talking about one woman mocking an adopted child in the romney family. there was a tearful apology there. there was a quote yesterday, the president of msnbc talked about the philosophy of his network and apologized. then he said this i've never had an ideology. an ideology is a single thought across all programs. he went ton say we've never had that obviously. i hire people who fit the

sensibility. we do stay true to facts. you have to build your arguments. that's why i call it -- that's why i call it a sensibility. this is why you have the the third firestorm. what's going on over there in the locker room? somebody's been told to push the envelope on a daily basis. i've never seen people backtrack more quickly, more frequently. >> i think certainly phil has his hands full there with comments that have been made reflecting intolerance. this tweet that was eventually taken down after, you know, a firestorm and backlash really, it kind of backfired because it was baseless. but the head of the r.n.c., the chairman there, he had this to say. >> in their professed world of tolerance, they're sure hitting on all eight cylinders of intolerance. you know, it started with, you know, melissa perry and

comments about mitt romney's new grandchild, martin bashir and palin. we had one of their new hosts coming up that's talking about some of the physical disabilities of that soldier hero from tuesday night and using that as a political statement. here's what we did. this tweet came last night. first thing in the morning i called mr. griffin, left a message, sent him a letter saying we were not going to allow any of our surrogates or myself or, and all of the other world of republican surrogates on their show until they, one, apologize. and, number two, did something of some corrective action on their shows to take some action. >> so what happened after reince preibus called for a boycott? phil griffin did apologize and he reportedly fired the

decision there to not stay safe where you were but actually do what? take us back. >> that morning the weather got pretty bad pretty quickly and caught a lot of people off guard. i had a delivery to make and was leaving to make that delivery. the customer said she still wanted it. after i left, i was traveling over two hours and was just over halfway there. then i called her seined i'm sorry, i'm not going to be able to make it. i pulled over in my vehicle and noticed the home depot was out in the middle of the highway giving out water to people. i had these boxed meals and said these people can use something to eat and so i started giving those out to them. after that was gone i was able to make it back to the restaurant where my people weren't able to leave or tried to leave and had to come back because they couldn't get anywhere. we all started preparing more sandwiches to give to the people stranded in

front of my restaurant. >> the remarkable thing is in a time of emergency, which it was and truly for you and your employees -- everyone needed to get back home and get safe -- you all decided not to hunker down and do what you needed for yourself. you decided to make food until you didn't have any more. why? >> it was the right thing to do. there were people that had been in their cars four, five and six hours. people were very appreciative when we were able to get them some type of nourishment. they weren't able to eat lunch because the storm came in so quickly. it was an opportunity and the right thing for us to do. >> i know people out there said they wanted to pay for the food. you and your employees decided, no. you all had the same mind set. what is that based on? free food? helping others. where does that come from? >> that comes from chick-fil-a and the family that founded chick-fil-a. we're in the restaurant business but our goal is to help people. >> you know what?

as a parent this video may be difficult for you to see. caught on camera, it was a pretty incredible moment that a baby is pulled out from the rubble. take a look. it was a two-year-old girl, a toddler. she was buried by an airstrike by the syrian government. it hit her home in aleppo. rescuers heard the girl crying and kept digging tphe they pulled her out. there is good news coming out of this. she has made -- look at her, beautiful little girl -- a full recovery. such a tragedy in that area. unbelievable video this time coming out of thailand this morning. terrified passengers throwing themselves off a boat as the boat begins to sink. 13 people on board at the time when the dive boat started taking on water. another boat was close by

and able to rescue all the passengers. the boat was not registered and was operating near this area illegally. an 11-year-old girl who had her cupcake business shut down by the health department because she didn't have a licensed kitchen says she is not giving up her baking. she and her mom spoke last night with megyn kelly. listen to this. >> well, i'm not sure if i'm going to have to shut down for good or like just wait awhile. but we're trying to figure out a way that i can follow all the rules and still get to bake and sell stuff. >> way to go. she has been selling those cupcakes for two years and the health department just found out about the business when her success story was featured in the local paper. students left hungry at school and now their angry parents and kid are fighting back against a salt lake city school district. this after dozens of students had their school lunches taken away and thrown in the garbage.

why? because administrators say there was not enough money in their prepaid lunch accounts. parents were never notified and they're outraged about how the school handled it. >> unfortunately my daughter called me on her lunch hour crying saying she couldn't eat lunch. over $4 and i was never notified she was in the negative. >> the last thing you do is confiscate lunches especially in a public setting in front of peers. >> the school district is apologizing and says it is now investigating why so many parents were unaware of their low account balances. those are your headlines. how on earth could someone do that? i have no idea. >> it is between the parents and the school. don't take it out on the kids. >> exactly. so wrong. >> how about an investigation into the ethical game time behavior and decision making when it comes to kids lunches. >> thank you, heather. it is currently the warmest it has been at this time in the last week. maria molina is live in times square with the

if they're lucky, a lot of full-time elected officials receive pensions. full time. now in illinois, even those who work part time are getting lifetime benefits. in fact, just 42 former part-timers in illinois collecting -- receiving collectively over $200,000 a year. should your tax dollars go to support part-time workers so they get full-time pensions? stuart varney weighs in on this. how do they let that happen in illinois? >> let me reverse it for a second. if you work in the private sector, you work part time for a few years. do you think you are entitled to a pension for the rest of your life because of that part-time limited work? do you think you should be allowed to vote your own pension? that's what's happening in the public sector in illinois, which happens to be the most trouble state

financially because of their pension -- >> some might say corrupt. we've been talking over the last year or so, illinois might need a bailout. as you pull, like an onion, peel it off layer by layer and now you see a bunch of part-time people are getting gigantic pensions. >> let me break this down. illinois has a $100 billion pension obligation. that is how much they've got to pay out in the future. they've got a plan to control it, but that plan does not include ending pension, lifetime pensions for people who work part time. in fact, when one of these former council members in a small town outside chicago, when one tried to say i don't think we should be getting this pension for part-time work, he was voted down. and they voted to continue this payment pension obligation. >> what is jaw dropping is if people are really lucky, it used to be back in the day people would get a pension -- very few have it

>> i think she's adorable. >> you're so gracious. >> maria molina, always keeping us abreast of what's going on of the everyone is talk super bowl weather. what do you have for us right now? >> hello. good morning. live here from times square, which as you know is now super bowl boulevard. we're actually on top of the fox sports tower in times square. to my north we actually have central park way off there. you can see traffic slowly starting to build up in new york city and of course, to my south, 13 blocks of super bowl activities here for super bowl boulevard. otherwise let's look at the weather conditions because we do have temperatures that are warming along the east. so this is good news. that means the northeast is going to be warming for the super bowl just in time. parts of the southeast also looking at warmer conditions. so that's going to allow that snow and ice that fell across parts of the carolinas, georgia and florida, to continue to melt. that's good news out there. otherwise a storm system across the rockies is producing snow.

quite significant in portions of the colorado rockies where we do have over a foot of snow expected. winter storm warnings in effect and chicago, you're under a winter storm watch because you could see over six inches of snow as we kick off the weekend. that will be something else to watch. please be careful on the roadways out there. otherwise for the super bowl, like i mentioned, temperatures warming. we'll be well above average. we could actually see a high temperature on sunday here in the new york city area and northern jersey that could possibly reach 50 degrees. for kickoff, in the 40s. not bad. now let's head over to brian. >> thank you very much. 25 minutes before the top of the hour. super bowl week that was billed as a war of words lived up to the hype finally yesterday and it's in the back page of the paper. seattle's richard sherman saying peyton manning passes will be, well -- keep going. they will be, quote, accurate

people with the president's signature health care piece. a new kaiser foundation survey finds 47% of those polled have an unfavorable view of the law while 24% are in favor. the remainder didn't indicate those -- those polls didn't indicate feelings, but the disapproval numbers are up from last month, which was around 43%. how about the folks who have yet to submit a payment? remember the administration is counting them as enrolled, but insurance expert told media sources he predicts between 10 and 20% of enrollees will get dropped because they didn't complete the payment process. what about the labor unions? they're a big chunk of clientele. this week the hill reported two union leaders took a firm stance pushing back against proposed regulatory changes. they say parts of this law will drive up certain health plan cost and hurt people in the working class. those who support the administration say it's all still a work in progress.

>> will she be extradited? >> i would absolutely fight it. i would take this case for free. the fact that she has now acquitted by one court to try her a second time under the american constitution would constitute double jeopardy. i believe just as the way mexico doesn't -- we have double jeopardy protection. our citizens, i believe that she could fight extradition and she'll appeal it. >> so you're saying that right now she'll not be extradited, she'll fight it legally. do you think our country would say, hey, sorry, italy. we're friends, but she's not going anywhere? >> there is an extradition treaty, but here is what she does. first appeals in italy. that takes a year. now let's say she loses that appeal. i think she has a chance of winning it. say she loses that appeal. then it comes time for the extradition. there's a treaty between italy and the united states. but i don't believe the united states -- and there is plenty of precedent -- would be required to extradite her.

democrats seem to be taking on a new year's resolution and going running. they're running away from the president right now. we have seen obamacare rollout to be quite a failure when it comes to the number of policies that have been canceled. they're looking at their town, their cities, their state saying, all these people are having these policies canceled when the president comes in town, they seem to have something else to do. what is the word on the street when it comes to the separation and not really wanting to take that moment with the president as we move into the midterm elections? >> look, elisabeth, the fact is that nationally, the president's approval rating is 42%. when they ask do you trust he'll do the right thing? it's in the 30s. and that's nationally. so think about in a red state, if you're mary landrieu in louisiana or kay hagin in north carolina, so yeah. it's not particularly good for your health if the president is coming to do an event. it's funny, 'cause sometimes these guys ride on air force one with the president. but then when they get there,
